What is discrimination by Victimisation?

Victimisation is commonly used to mean any treatment, which a person thinks is unfair or unequal and makes him/her feel like a victim.

However, victimisation in accordance with the Act is very specific and only occurs when the person alleging victimisation has:

  • brought proceedings aganist the discriminator or any other person under the Act, or any relevant law;
  • given evidence or information in connection with proceedings brought by any person against the discriminator or any other person under the Act, or any relevant law;
  • otherwise done anything under or by reference to the Act, or any relevant law, in relation to the discriminator or any other person; or
  • alleged that the discriminator or any other person has committed an act, which (whether or not the allegation so states) would amount to a contravention of the Act, or any relevant law, or by reason that the discriminator knows the person victimised intends to do any of those things referred to in paragraphs (a) to (d), or suspects the person victimised has done, or intends to do, any of them.
